Website terms of use
Version of 29 August 2026
These terms of use (the "Terms") govern access to the www.easyrecordstudio.com website (the "Site") and use of the account hosted on it. They cover the Site and the account only. The EasyRecord Studio desktop application has its own terms of use, accepted separately when it is first launched.
Article 1: Purpose
The Site presents the EasyRecord Studio software, allows the creation and management of an account, authentication, retrieval of the application and access to related information. These Terms set out the rights and obligations of the publisher and of any visitor or account holder.
Article 2: Publisher
The Site is published by Jacques LE FILS, a natural person acting as an independent publisher. Contact: contact@ers.com.
Hosting is provided by a third party, reachable through the publisher at the address above.
Article 3: Access to the Site
The Site is freely accessible to any visitor with an internet connection. The costs of that access (equipment, connection) remain the visitor's responsibility. The publisher uses reasonable means to keep the Site available, with no obligation to achieve a specific result, and may suspend access for maintenance or for technical reasons.
Article 4: Account creation and management
Creating an account requires accurate and up to date information. The account is strictly personal. You are responsible for keeping your credentials confidential and for any activity carried out from your account, and you undertake to report any unauthorised use without delay.
You warrant that you have the legal capacity to accept these Terms. One account per person is allowed. The publisher may suspend or delete an account in the event of clearly false information, a breach of these Terms, fraudulent use or a threat to the security of the Site.
Article 5: Acceptable use
You undertake not to interfere with the operation of the Site, not to attempt unauthorised access to its systems or to other users' accounts, not to harvest data by automated means and not to use the Site for unlawful purposes or purposes contrary to public order.
Article 6: Intellectual property
The Site, its structure, its texts, its graphic elements, its logos, the name "EasyRecord Studio" and the "ers" acronym are protected by intellectual property law and remain the exclusive property of the publisher or its licensors. Any reproduction or reuse, in whole or in part, without prior written authorisation is prohibited, except for the acts strictly necessary for normal viewing of the Site.
Article 7: Personal data
The data collected when creating the account and when browsing is processed in accordance with the publisher's privacy policy. You have a right of access, rectification, erasure, restriction and objection, which you may exercise at contact@ers.com.
Article 8: Liability
The Site is provided as is. The publisher does not warrant that it is error free or continuously available. To the extent permitted by law, its liability is limited to direct and proven damage resulting from a fault attributable to it, excluding in particular indirect damage and data loss. Nothing excludes the publisher's liability where the law prohibits it.
Article 9: Changes to the Terms
The publisher may amend these Terms at any time. The applicable version is the one in force when the Site is accessed. In the event of a substantial change, account holders are informed by an appropriate means.
Article 10: Governing law and disputes
These Terms are governed by French law. In the event of a dispute, the parties will seek an amicable solution before any legal action. Failing agreement, the dispute will be brought before the competent French courts, subject to the mandatory rules applicable to consumers. A consumer residing in the European Union may also use the European Commission's online dispute resolution platform.
